Hosted Terms
These terms apply when a club pays for Club Hosted, Club Plus, or Club Dedicated. Together with your invoice, they are the agreement for that Hosted subscription. Last updated: 15 August 2026.
In plain language. You own your club’s scores, rosters, and seasons, and a Club Admin can export them anytime. We host the software — we do not sell you the copyright, and Club Hosted / Plus is not a private VPS (that is Dedicated). Support is email within 24–48 hours on support days, not a Saturday hotline. If an Admin turns on the public board, shooter names and standings can be seen without login. People who operate the Hosted service can access the server to keep it running.

What this page covers
These Hosted Terms apply to paid Club Hosted, Club Plus, and Club Dedicated on infrastructure we operate (app.nobirdscoring.com and any club hostname we map for you).
They do not govern:
- The marketing site at www.nobirdscoring.com — see Privacy.
- The live Tour at demo.nobirdscoring.com. Tour uses sample data, may reset on a schedule, and is not a paid recovery target. Do not enter real member personal data there.
- Self-host or a classic single-club system the club runs on its own server. Those use a separate license or memorandum.
- Launch, Training, Consulting, or range-network projects. Those are scoped on their own invoice or statement of work.
Who is bound
These Hosted Terms are offered by No Bird Scoring LLC, a Wisconsin limited liability company (“we”, “us”). Contact: [email protected].
The Club is the organization named on the invoice. The person who pays or accepts these terms represents they can bind that Club. Shooters and members are the Club’s users, not our customers.
We may assign this agreement to a successor of No Bird Scoring LLC and will update this page and your invoice. Your rights to your data and export do not change.
The Hosted service
We will provide the Club a non-exclusive, non-transferable right to use the then-current Hosted application for the Club’s own clay-target league, events, and clubhouse operations (including members and authorized volunteers acting for the Club). Product updates on that Hosted instance are included.
What the plan enables (scorepads, standings, rosters, schedules, Night Desk-style ops, exports, multi-discipline boards) is as the live product provides for that SKU — not as a demo, slide, or verbal walkthrough. We may change features. We will not silently convert a shared Hosted club into Dedicated, or the reverse, without a new invoice.
We do not provide certified ATA / NSSA / NSCA electronic filing, a native phone app, in-app card collection for events or dues, full club accounting, managed range hardware, or club Wi‑Fi repair as part of Hosted.
Your data
Operational data the Club enters — shooters, scores, seasons, events, and similar records — is owned by the Club. We claim no ownership of that data.
While the subscription is active, a Club Admin may export Club data in the formats the product then provides (including Excel-friendly CSVs, a leave-behind ZIP, and a full JSON backup). A routine export does not require us.
We receive only a limited right to host, process, display, and back up that data in order to run the Hosted service, including any public board the Club turns on. We do not sell Club data.
People who operate the Hosted service can access the host and database as needed to run, restore, debug, and support the service. This is not a product where we cannot read Club data in order to operate the host.
Our backups vs your export
We operate infrastructure backups of the hosted database and file storage so we can restore the Hosted service after host failure, corruption, or operator error. Schedule, retention, off-box copies, and restore process are in the then-current Backup & Restore Policy. Those backups are not a document archive, not officer-accessible, and not the same file as Admin → Export.
We will restore Hosted service from a backup as soon as practical in a published support window. Club Dedicated and any separately paid shoot-night window go to the front of that queue. Restore is not on-site coverage and is not a promise that a league night will finish on electronic scoring if the outage begins after support hours.
A reasonable restore after a Club-caused import or admin mistake is included. Repeated full-club rewinds, or rewriting one team’s scores from backup while the rest of the club stays live, are scoped consulting or Launch hours.
Recovery point and time figures in the Policy are design targets, not service credits, unless a later written SLA says otherwise. We do not warrant zero data loss, immutable vendor object storage, or recovery of data the Club never successfully saved.
If the service ends
If the Club ends the subscription or we permanently stop the Hosted service, we will, on written request within 30 days, make a then-current Club export available. After that window we are not obligated to keep Hosted backups except as remaining retention happens to hold them. The Club should keep its own export in a club-controlled place.
Continuity if we disappear is that export, Club Admin logins the Club controls, and a paper/offline night plan — not a claim on our cloud account, and not a copy of the multi-tenant source.
Software and brand
We and our licensors own the software, schema, interface, documentation, and the No Bird Scoring name and marks. The Club receives only the hosted-use rights in these terms.
Buying Hosted is not an assignment of copyright, not a source-code license, not a work made for hire, and not a right to host scoring for other clubs, sell or give the software away, or operate a scoring bureau. Suggestions you send us may be used to improve the product; that does not transfer your Club data.
Shared Hosted vs Dedicated
Club Hosted and Club Plus share one application and one database. The Club is a separate tenant (club record + membership rules). Other clubs cannot read or write the Club’s private scores, rosters, seasons, or money records; we test that automatically. That is logical isolation. It is not a private server, not one physical database per club, and not a hardware-isolated environment.
Club Dedicated is a separate stack when the Club wants that kind of isolation, capacity, custom hostname priority, or priority restore. Dedicated is an ops and capacity choice — not because shared Hosted is “broken.”
A mapped hostname (for example a club subdomain) is available when DNS and the build are set up. It is not automatic on every SKU.
Platform / superuser access is an operator role. It is not a Club officer role.
Public boards and names
If a Club Admin turns on Public dashboard, standings and shooter display names for that club are visible without login. That is intended. Memberships, login emails, dues, ledger, and shop records stay sign-in gated.
The Club controls the toggle and is the publisher of whatever that board shows. Leave Public dashboard off if names should stay inside the club. We are not a records custodian, not an official scoring body, and not a background-check vendor.
Accounts and acceptable use
The Club is responsible for who it makes an Admin or scorer, for keeping those credentials in a club-controlled place, and for the accuracy of rosters and scores it enters. We recommend two Club Admins so scoring does not live in one volunteer’s head.
The Club will not:
- use Hosted to score or host other organizations as a service
- resell the instance
- share operator/superuser access
- attempt to read another club’s private data
- put health records or other data the product is not built for into Hosted
- put real member personal data in the Tour
We may suspend the service for a serious breach of this section after notice when practical.
Invites and password resets are part of Hosted. Optional marketing / newsletter sending is metered under the then-current pricing schedule (one send to one recipient = one). Unused allowance does not roll over. We may pause marketing sends when the cap is hit. The Club is responsible for having permission to email its list and for the content of those messages.
Support
- Email or the contact form only — no phone, SMS, or live chat as default support.
- We aim to reply within 24–48 hours on evenings and weekends (US operator). We do not monitor tickets during a weekday job.
- Included: help with the product, account access, and (on Hosted) platform availability and restores from backup per the published Backup & Restore Policy.
- Priority on Plus or Dedicated means first in the next support-block queue (including restore tickets). It does not mean we drop other work mid-day or text all night on a shoot.
- Not included unless a separate paid arrangement is in writing: on-site visits, custom software development, club network / Wi‑Fi repair, or live on-call during league or tournament days.
- First league night after go-live is an async window unless a paid window was sold.
Fees and payment
Software is billed by invoice (ACH, wire, or check). There is no self-serve card portal and no in-app collection of event or dues cards.
The invoice controls SKU, amount, service dates, and due date. List prices on the Plans page are ballpark; the invoice is the price.
Go-live proceeds when funds have cleared or (founding / pilot only) a signed memorandum plus an agreed go-live date is on file. A verbal “we’ll pay” is not paid.
Subscription fees may increase by about 5% per year on a later term, with at least 30 days’ notice. Launch, Training, Consulting, network design, email packs, and paid shoot-night windows are billed separately.
Prepaid unused Hosted time is not refundable except as required by law. If a Launch project has not started, unused Launch hours on that invoice may be cancelled. We may suspend Hosted after written notice if an invoice stays unpaid.
A later term requires a new invoice. We do not auto-charge a card and we do not treat silence as renewal.
Term and cancel
The subscription starts on the service date on the invoice and runs for the term on that invoice.
Either party may end the subscription with 30 days’ email notice. We may suspend or end it sooner for non-payment or a serious acceptable-use breach.
Export rights during the 30-day wind-down in “If the service ends” survive cancellation. Software-license, data-ownership, backup, liability, indemnity, and law sections also survive.
Scores, the range, and what we are not
Standings and scores in the product are operational tools. The Club is responsible for checking results before awards, handicaps, or any official submission.
This is software. We do not operate the range, certify safety, sell firearms, or replace the Club’s insurance, waivers, or governing-body rules.
What we do not promise
We do not claim or include:
- Round-the-clock coverage, a Saturday hotline, or on-site shoot-night staffing (unless a paid window is in writing)
- 100% uptime, an availability percentage, or service credits
- Audit certifications, “bank-grade” isolation, health-data compliance, or card-processing certification as a Hosted feature
- One physical database or private VPS on Club Hosted / Plus
- Zero data loss, or a restore before the next squad
- Officer access to our infrastructure backups
- Source code, source escrow, or ownership of the multi-tenant product
- Unlimited marketing email
- Certified association electronic filing
- Mixing Tour / demo data with a paid Hosted club
Warranties and liability
The Hosted service is provided as is and as available. We do not warrant that it will be uninterrupted, error-free, or fit for a particular awards night.
To the fullest extent allowed by law, we are not liable for lost profits, lost scores, replacement scoring labor, or other indirect or consequential damages.
Our total liability under these terms is limited to the Hosted fees the Club actually paid in the 12 months before the claim (or the fees on the invoice that is the subject of the claim, if less).
The Club will defend and pay claims brought by its members, guests, or other third parties arising from data the Club entered, names or scores the Club published (including on a public board), or the Club’s misuse of the service.
Nothing here limits liability that Wisconsin law does not allow to be limited (including fraud or willful misconduct).
Changes
We may update these Hosted Terms. The “Last updated” date at the top will change when we do. For a change that affects fees, tenancy, export rights, or the liability cap, we will give the billing contact at least 30 days’ email notice.
The invoice that names a dated copy of these terms governs that invoice’s term. Continued paid use after a notice date is acceptance of the updated terms for the next term.
Notices and law
Notices under these terms may be sent by email to [email protected] and to the billing email on the invoice.
These terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules. Exclusive venue is the state courts in the Wisconsin county of our principal office, or the federal court for the district that includes that county. Before filing, the parties will try to resolve a dispute by email for 15 days. Either party may use small-claims court for amounts that court allows.
These Hosted Terms plus the invoice are the entire agreement for the Hosted subscription. On price, SKU, and service dates, the invoice controls. There are no third-party beneficiaries (shooters cannot sue us on this contract). The Club may not assign the subscription without our consent. We may assign it as described under “Who is bound.”
If a court strikes one part, the rest stays in force.
